Fortune & Liber is a trading name of RawCircus Media Ltd. In these terms, “we”, “us” and “our” mean RawCircus Media Ltd, trading as Fortune & Liber.
These terms apply to purchases from Fortune & Liber and use of our website. By placing an order, you agree to these terms. Nothing in them limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or other applicable New Zealand law.
Alcohol purchases and age declarations
You must be 18 years of age or older to purchase alcohol from us. This applies to every alcohol order, including gifts. The person receiving the alcohol must also be at least 18.
Under section 243 of the Sale and Supply of Alcohol Act 2012, an underage person who purchases alcohol on or from licensed premises commits an offence and may be fined up to $2,000 on conviction.
You must provide truthful age information and must not make a false age declaration to obtain alcohol. You are required to confirm your age when entering our website and again immediately before completing a purchase. At checkout, you must also confirm that anyone receiving the alcohol on your behalf is at least 18.
We may request evidence of age or decline an order where we cannot establish that these requirements are met.
Identification on delivery
Alcohol will only be handed to a person who is 18 or older and is not intoxicated.
If the recipient appears to be under 25, the delivery driver will ask to see identification. The driver may also request identification whenever there is doubt about a recipient’s age.
We accept the following original identification documents:
- A passport issued by New Zealand or another country.
- A New Zealand driver licence.
- A Kiwi Access Card.
- A Hospitality New Zealand 18+ Card.
Identification must be valid, current and belong to the person receiving the order. It must show their photograph and date of birth clearly. Expired identification, photocopies and photographs of identification will not be accepted.
Refused delivery and refunds
The driver will refuse to hand over alcohol if:
- The recipient is under 18.
- The recipient is intoxicated.
- The recipient cannot show acceptable identification when asked.
We reserve the right to refuse any order and any delivery for any reason as permitted by New Zealand law.
If delivery is refused for any of these reasons, the parcel will be returned to our base and the order cancelled. We will issue a full refund, including the original delivery charge, to the original payment method within three working days of the refused delivery.
After we issue the refund, your bank or payment provider may take additional time to credit your account. For payments processed through Shopify Payments, this can take up to 10 business days.
For these terms, a working day means Monday to Friday, excluding New Zealand public holidays.
No unattended deliveries or redirection
We will not leave alcohol unattended. This includes doorsteps, porches, garages, letterboxes and any other nominated “safe place”. Authority to leave instructions will not be accepted.
Orders must be received in person by the named purchaser at the delivery address confirmed with the order. A signature is required.
We will not redirect parcels to another address or deliver them to a third location, including a neighbour’s property, parcel locker or collection point. These requirements also apply to rural deliveries.
Please check the recipient’s name and delivery address carefully before ordering. If you notice an error, contact us before dispatch. Any correction must be confirmed by us before the order is sent.
Delivery service
We deliver to New Zealand addresses within the delivery areas available at checkout. Standard deliveries take place on working days, excluding public holidays, Good Friday, Easter Sunday, before 1 pm on Anzac Day and Christmas Day.
Any delivery timeframe quoted is an estimate unless we expressly agree otherwise. If an order is delayed or missing, contact us so we can investigate with the carrier.
Alcohol deliveries must comply with the Sale and Supply of Alcohol Act 2012 and the conditions of our off-licence. Alcohol will not be delivered between 11 pm and 6 am.
Fortune & Liber operates through remote sales. Our storage premises are not open to customers for shopping or order collection.
Prices and payment
Prices are in New Zealand dollars and include GST. Delivery charges and any other applicable fees will be disclosed before you complete your purchase. We do not add a surcharge simply because you purchase one bottle.
Payments are managed through Shopify. Available payment methods are those displayed in our Shopify checkout. Payment must be received before an order is dispatched.
Prices may change for future purchases. If we identify a material pricing or product error affecting your order, we will contact you to agree a resolution. We will not charge a higher price or supply a different product without your agreement.
Returns and product problems
If an order arrives broken, damaged, incorrect or otherwise faulty, contact us promptly. We will arrange a replacement, refund or other remedy required by New Zealand consumer law, at no additional cost to you.
To help us investigate quickly, please:
- Report damage or breakage, where possible, within 48 hours of delivery.
- Tell us about a missing or incorrectly delivered order, where possible, within 12 days of dispatch.
- Contact us about suspected cork taint or another wine quality issue, where possible, within 30 days of purchase.
These are requested notification periods, not deadlines that remove your statutory rights.
If you believe a wine is corked or tainted, retain the bottle and any remaining contents where safe to do so, so that we can assess the issue.
If a wine is not to your taste, contact us within 30 days of purchase. Under our additional satisfaction policy, we will arrange a replacement and/or the return of unopened bottles for a refund.
Please contact us before returning goods so we can agree a suitable return method. Where rural courier collection is unavailable, we will agree an alternative arrangement. We cover reasonable return costs for faulty or incorrectly supplied goods. This returns policy applies to orders delivered within New Zealand.
Product availability
If a product becomes unavailable after you order it, we will contact you promptly. You may choose a refund for the unavailable item, an agreed alternative, or to wait for new stock if a restock is expected.
We will not substitute a product or vintage without your agreement.
Privacy and communications
We handle personal information in accordance with the Privacy Act 2020. We use information supplied to us to process orders, arrange delivery, communicate with you and meet our legal obligations.
We do not sell your personal information. We may disclose information where required or permitted by law.
We take reasonable steps to protect personal information and retain it only for as long as needed for legitimate business or legal purposes. You may request access to, or correction of, personal information we hold about you by contacting us.
